Madison murder suspects, attorneys, prep for trial

Danna Weimer faces jury Monday, motions to suppress evidence, questioning

PAINESVILLE — The wheels of justice are turning for Danna and Zachary Weimer as both murder suspects prepare for trial, Lake County Common Pleas Court records show.

Ashtabula County residents Zachary and Danna Weimer face 17 charges each — ranging from aggravated murder and aggravated burglary to tampering with evidence and receiving stolen property, in the brutal murder of 77-year-old Madison Township resident Eleanor Robertson in June.

Zachary Weimer, 22, was present for a pretrial hearing on Wednesday in Judge Vincent A. Culotta’s courtroom, court bailiff Ken Roberts confirmed.

Roberts said Weimer signed a waiver of time limits for the trial and reviewed signed paperwork in preparation for his criminal trial, which has not yet been scheduled.

“The attorneys exchanged discovery and (Weimer) was brought over for about five minutes to review the documents,” Roberts said.

Zachary R. Weimer is charged with two counts of aggravated murder, two counts of murder, two counts of aggravated robbery, two counts of aggravated burglary, one count of felonious assault, two counts of tampering with evidence , one count grand of theft of a motor vehicle, one count of theft from an elderly person, three counts of receiving stolen property and one count of engaging in a pattern of corrupt activity.

His mother, Danna Weimer, 52, will face a jury Monday as her trial begins, court records show.

Danna Weimer’s attorney Aaron T. Baker filed motions this week to suppress evidence and statements, “gathered during continuing unconstitutional and custodial questioning,” court records show.

Baker also filed a motion to allow Danna Weimer to appear “in civilian clothing without restraints at all proceedings,” court records show.

She is charged with four counts of receiving stolen property, two counts of possession of drugs, one count possession of heroin, one count of possession of cocaine, one count possession of dangerous drugs, one count of aggravated possession of drugs, two counts of receiving stolen property, two counts of tampering with evidence, one count of aggravated burglary, one count of aggravated murder and one count of engaging in a pattern of corrupt activity.

Robertson, the victim, was found dead in her Canterbury Drive home by Madison Township police on June 13, the victim of an apparent burglary.

She was bludgeoned to death and had 90 puncture wounds across her body, Lake County Coroner Lynn Smith said. Robertson’s body had been burned or doused with chemicals and was found under layers of clothing and a mattress.
